MEMBER'S TERMS AND CONDITIONS

MEMBER'S TERMS AND CONDITIONS

1.0 PAYMENTS
1.1    Your payment covers more than just access to coaching sessions. Your payment also covers the intro session, personalized nutrition coaching, weekly out-of-session personal coaching support and monthly health assessment scans with the InBody Scanner.

1.2    Trials are paid in full as a lump sum with a debit/credit card in advance and the Trial begins the day you complete your Intro Session.

1.3    6 Month and/or 12 Month Memberships are made through automatic recurring payments with debit/credit card every month.

1.4    6 Month and/or 12 Month Membership have a one time pause up to a month during the initial contracted period of 6 months and/or 12 months.

1.5    Cancellation of the 6 Month and/or 12 Month Membership prior to the expiration of the minimum 6 Month and/or 12 Month contracted period requires an early termination fee equal to 50% of the remainder of the contract - so please choose your contract option appropriately.

1.6    Once the 6 Month and/or 12 Month membership contracted period ends, you will automatically enter into a rolling monthly contract, where a one month notice period is required for cancellation.

2.0 REFUNDS
2.1    You, the Member, will not be able to refund, transfer or carry forward memberships, coaching sessions, nutrition coaching, weekly out-of-session personal coaching or any InBody Scans.


3.0 CANCELLATIONS AND SCHEDULING
3.1    You, the Member, will be required to book, cancel, and/or reschedule all your sessions with 1 hours' notice. 

3.2    You are limited to booking and attending 1 coaching session per day and up to 3 coaching sessions per week. 

3.3    You will be able to book up to 7 days in advance - this is to prevent anyone from forgetting to show up for their coaching sessions.

3.4    If a coaching session is full, you will be automatically put on a waitlist and automatically added at least 1 hour before coaching session start time to automatically join.

3.5    All coaching session times may change or be cancelled at any time and you will be notified by email and/or text message as soon as possible before the coaching session.

3.6    While exercise is important, if you are sick, please cancel your coaching session booking(s) until you are fully recovered.

3.7    All coaching sessions must be booked in advance on the booking system because it is required to maintain records of who’s been in the premises at all times so if you haven’t booked you will not be able to train, there will be no exceptions.

3.8    If you can’t make a session that you’ve booked in for you MUST cancel your booking on the booking system to make room for someone else, repeated no shows will result in membership cancellation.

3.9    There will be no admittance for late arrivals as this will disrupt the coaching session and compromise the COVID-19 secure measures we have in place, so please be on time - if you know you’re going to be late please cancel and re-book for a later time slot.


4.0 SUSPENSION/TERMINATION OF MEMBERSHIP
4.1    If the Member behaves in a way that breaches the Member’s Terms and Conditions, then trials and memberships can be suspended and/or terminated.


5.0 HOLIDAYS AND ABSENCES
5.1    There will be no coaching sessions on all statutory holidays and heavy snow days. 


6.0 LOST PROPERTY OR THEFT
6.1    All Members take full responsibility  for the loss and/or theft of any personal belongings. Any items left on the premises will be kept for a period of 1 week before being disposed of.


7.0 AFTER COACHING SESSIONS
7.1    All Members must vacate the premises immediately after each coaching session.


8.0 COMMUNICATION
8.1    All questions, concerns, comments or requests will be responded to within 1-5 business day.


9.0 PHOTO AND VIDEO CONSENT
9.1    Photographers and videographers will take photographs and videos of Members during coaching sessions for social media pages, websites or any advertising material. Members will be informed at least 5 business days before a photographer and videographer will arrive at the premises.


10.0 100% MONEY BACK GUARANTEE
10.1    In order to be eligible for the 100% Money Back Guarantee (if appropriate) you must have attended 3 coaching sessions per week at Shen Fitness, used MyFitnessPal to meet your nutrition targets (set by Shen Fitness) every day, checked in with your coach every Monday on Trainerize and completed 2 measurement sessions with Shen Fitness for the entire trial period and got zero results (zero weight loss, zero body fat percentage dropped OR zero muscle gained).
